Common Law Tenancy (CLT)
- The law is subdivided into two parts.
- Statute (provided by Acts of Parliament) and
- Common Law (provided by cases presided over by the judiciary).
- The latter covers this type of tenancy.
- CLTs are suitable for non- ASTs
- I.e. company lets,
- Tenancies over £100,000,
- Lodger with owner occupier i.e. resident landlords,
- Tenancies under £250pa (£1000 London) etc.
- Common Law rules apply to any such CLT eviction and not AST rules.
- S.8 and S.21 notices are not available for evicting CLT tenants.
