Rights and Obligations
- It is said by landlords that, "tenants have rights whilst landlords have obligations"
- All parties to a contract including a tenancy agreement, have both rights and obligations.
- These are established mainly by terms of the tenancy agreement but also via implied by statute and common law.
- E.g. Warren v Keen 1954 -
- tenants have an obligation "to use the premises in a tenant-like manner"...
- The tenant must repair damage to the premises caused, wilfully or negligently, by him, his family and his guests."
