Rights and Obligations

  • It is said by landlords that, "tenants have rights whilst landlords have obligations"
  • All parties to a contract including a tenancy agreement, have both rights and obligations.
  • These are established mainly by terms of the tenancy agreement but also via implied by statute and common law.
  • E.g. Warren v Keen 1954 -
    • tenants have an obligation "to use the premises in a tenant-like manner"...
